GEORGIA, SCREVEN COUNTY NOTICE OF SALE UNDER POWER Because of default in the payment of a note secured by a deed to secure debt executed by Albert Eugene Hayes, Jr. and Kimberly Dawn Hayes, dated February 3, 2016, recorded in Deed Book 2331, Pages 223-228, Bulloch County records, the undersigned has declared the full unpaid amount of the indebtedness referred to due and payable and, acting under the power of sale contained in said deed, for the purpose of paying said indebtedness, will on the first Tuesday in December, 2024 during the legal hours of sale at the Bulloch County Courthouse, sell at public outcry to the highest bidder for cash, the lands described in said deed, to-wit: All that certain lot, tract or parcel of land lying and being in the 48th G.M. District of Bulloch County, Georgia, being designated as Parcel No. 2 containing 1.27 acres, more or less, as shown on that certain plat of survey prepared for E.C. Childers, by Lamar O. Reddick, Registered Land Surveyor, dated November 21, 1977, and recorded in Plat Book 18, page 51, Bulloch County Records, which plat of survey is by reference incorporated herein as a part of this description. Said tract is further identified as Parcel No. 2 on Map 146 in the office of the Tax Assessor of Bulloch County, Georgia. The street address for the real property is 16727 Burkhalter Road, Statesboro, Bulloch County, Georgia 30461, according to the present system of numbering houses in Bulloch County, Georgia. This is the same property conveyed from Anthony F. Pugliano, acting through his attorney-in-fact, Farmers and Merchants Bank of Sylvania, Georgia, to Farmers and Merchants Bank, Sylvania, Georgia, by Deed Under Power dated January 5, 2016, and recorded in Deed Book 2327, pages 615-617, Bulloch County Records. Said property is to be sold subject to any outstanding ad valorem taxes (including taxes, which are liens, but not yet due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens and encumbrances, zoning ordinances, restrictions, covenants and matters superior to the aforesaid Deed to Secure Debt first set out above. Said property is also sold "as is" without any representation, warranty, or recourse against the above-named creditor or the undersigned.
