STATE OF GEORGIA COUNTY OF BULLOCH NOTICE OF SALE UNDER POWER By virtue of the Power of Sale contained in that certain Security Deed given by BVT-MICHELS, LLC, (the "Borrower") to BENJAMIN W. GRIFFITH, III, (the "Lender") dated November 3, 2022, and recorded in Deed Book 2755, Pages 438-441, in the office of the Clerk of the Superior Court of Bulloch County (the "Security Deed"), such Security Deed conveying the following described property which secures a Note from Borrower dated November 3, 2022, in the original principal amount of $5,760,000 (the "Note") with interest at the rate specified therein; there will be sold by the undersigned at public outcry to the highest bidder for cash at the Bulloch County, Georgia Courthouse within the legal hours of sale on the first Tuesday in December, 2024 (December 3, 2024), the following described property: All that certain tract or parcel of land, lying, situate and being in the 1209th G. M. District, City of Statesboro, Bulloch County, Georgia, designated as "Remainder," containing 38.12 acres, as shown on that certain plat of survey entitled "Division Survey of 44.8 Acres," prepared for JGR Development, LLC, by John A. Dotson, Georgia Registered Land Surveyor, dated September 7, 2022, and recorded in Plat Book Plat Book 69, Page 199, Bulloch County Records. The above referenced plat and the description thereon are incorporated herein and made a part of this description. Together with an easement for ingress and egress over and upon the driveway leading from Old Register Road to the area designated as "Parking Lot" on the tract designated as "Clubhouse Tract" on the above referenced plat as well as an easement for ingress and egress over the area designated as "Parking Lot" on the tract designated as "Clubhouse Tract" on the above referenced plat. The indebtedness secured by said Security Deed has been and is hereby declared due because of the failure to comply with the terms and conditions contained in the Note and Security Deed. The indebtedness remaining in default, the sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness secured by the Security Deed, accrued interest and expenses of the sale and all other payments provided for under the Security Deed, including attorney's fees as provided in the Note and Security Deed, and the remainder, if any, shall be applied as provided by law. The Property will be sold on an "AS IS, WHERE IS" basis without recourse against the Lender and without representation or warranty of any kind or nature whatsoever with respect thereto, with no assurance afforded to the exact acreage contained in the description and subject to all of the following, without limitation: (a) all outstanding taxes, assessments, and utility bills which are valid liens and encumbrances upon any of the Property and which are prior in right to the liens and security interests of Lender (including taxes which are lien, but not yet payable); (b) any and all easements, restrictions, covenants, encumbrances and other matters which would be revealed by an inspection or accurate survey of the Property; (c) all valid zoning ordinances; (d) rights of tenants under recorded and unrecorded leases; (e) all federal tax liens (if any) affecting any of the Property and the right of the United States Government relative thereto, including, but not limited to, the right of redemption of the United States Government, if any such rights validly exist; and (f) any and all easements, limitations, restrictions, reservations, covenants and encumbrances of record to which the Security Deed is subordinate in terms of priority.
