NOTICE OF SALE UNDER POWER OF SECURITY DEED STATE OF GEORGIA COUNTY OF BULLOCH Under and by virtue of the Power of Sale contained in the Deed to Secure Debt from MICHAEL JOHN KAAPA AND CHRISTINA M. KAAPA to ROBERT K. BELL, JR., INC., dated September 5, 2019, and being recorded in Deed Book 2526, pages 563-570, Bulloch County, Georgia Records, given to secure an indebtedness in the original amount of $44,500.00, the undersigned will sell, at public outcry, to the highest bidder for cash before the door of the Courthouse of Bulloch County, Georgia, during the legal hours of sale on the first Tuesday in MAY 2024, the following described property to-wit: All that certain tract or parcel of land lying and being in the 47th G. M. District of Bulloch County, Georgia, being 1.0 acres, more or less, of a 2.0 acre tract as shown in Plat Book 17, Page 138, less and except 1.0 acre conveyed in Deed Book 489, Page 323. Said tract of land is also known as Map and Parce #196-000-037-000 in the Bulloch County Tax Assessors Office and being more particularly described as follows: All that certain lot, tract or parcel of land situate, lying and being in the 47th G. M. District of Bulloch County, Georgia, and being described as follows: Commencing at the intersection of the southerly boundary of State Highway 119 and the westerly boundary of the right of way of a one hundred foot county paved road and running from said point of commencement along the said westerly boundary of the right of way of a county paved road in a southerly direction approximately one-tenth (.10) of a mile to a point; said point being marked by a concrete marker and thence running from said concrete marker along the westerly boundary of the right of way of a county paved road a distance of 526.5 feet to a point marked by a concrete marker, said point being the point of beginning and thence running from said point of beginning S 24o 40' E a distance of 180 feet to a point; thence running S 75o 18' W a distance of 485 feet to a point; thence running N 24o 40' W a distance of 180 feet to a point; thence running N 75o 18' E a distance of 485 feet to a point, said point being the point of beginning. Said lot, tract or parcel of land contains 1.0 acres, more or less, and is bound now or formerly on the North by lands of Sylvester Swinson; on the East by the right of way of a county paved road; on the South by a 20 foot unpaved road; on the West by a 20 foot unpaved road. Parr, dated December 19, 1977, and recorded in the office of the Clerk of Superior Court of Bulloch County, Georgia, in Plat Book 17, page 138. AND THAT CERTAIN 1996 Westfield Fleetwood Manufactured Home, Serial Number: GAFLT07A37103BM12, which has been made a part of this property by the filing of Form T-234 Mobile/Manufactured Home Certificate of Permanent Location filed with the Bulloch County Superior Court and being recorded in Deed Book 2736, Pages 255-257, Bulloch County Records. The indebtedness secured by said Purchase Money Deed to Secure Debt has been and is hereby declared due and payable in full by reason of default under the provisions of said Purchase Money Deed to Secure Debt and the terms of the Note secured thereby, and sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness and interest thereon, attorney's fees and expenses of sale, and the balance, if any, shall be applied as provided by law. To the best knowledge and belief of the Lender, said property will be sold as the property of MICHAEL JOHN KAAPA AND CHRISTINA M. KAAPA and is being sold subject to any and all liens superior to this lien, outstanding ad valorem taxes, and easements, restrictions against the property, if any.
